I was so happy to find your straight forward answer to how the 7500 tax credit effects new construction. I sold my home December 18, 2005 and am getting ready to close on a new construction loan to build a new house. To qualify for the 7500 tax credit does the first time home buyer you have to not have owned a home for 3 years. Does this mean that I can’s close until after December 18th or will they go by the date we move into the home?
Thank you in advance for your help…I am so confused what to day I don’t want to close less than a month early and lose the tax credit but I don’t want to wait if I can do it now so that I assure it is ready to move into before July 1st of 2009.
It is my understanding that they go by the date that you close on the home, not by the date that you close on your construction loan. The law goes by the date that you first occupy the home, not the date that you close on your loan. I hope this helps.
I really don’t know. But if I were to venture a guess, I would think not. I just don’t think that the federal government would take the time to file that little bit of information with the credit agencies. I could be wrong, but I would be really surprised if it did.
You have two issues that you are dealing with that I can see from your question. First, do you qualify as a new home buyer under the provisions of the bill, which states that only individuals who have not owned a home as a primary residence in the 3 years previous to the purchase qualify. If you have not owned the home that you have been living in, which it appears from the post that you have been renting, then you would meet this first qualification. Second, the bill regards the key date with new construction to be the date that the residence is occupied by the owner. Therefore, if you do not occupy the home by July 1, 2009, then it does not appear to me that you would qualify. Therefore, you would need to find a home where you could move in prior to July 1, 2009. Mr Griffin, I have a question for you. I am filing my taxes for the 2008 year and my tax preparer is telling me that I do not qualify for the $7500. My finance and but a house in may of 2008, it was my first house. I lived in a mobile home that I owned prior to that. I never took a mortgage out for that, it was a personal loan from the bank. The preparer is telling me that the mobile home could be considered my primary residence for the beginning of 2008, disqualifying me for the loan. Is he right?
Your tax preparer could be right. If your tax preparer is a CPA, then he would be a pretty authoritative source. However, with the new stimulus package that is before the Senate now, which is scheduled to be passed mid-week, you will most likely qualify for the $15,000 tax credit, as there is not a first time home buyer stipulation. Hi Jolene,
I sold my house in May 2006. Iam now thinking of purchasing a new home which is under constuction & will be ready for closing in Sept 2009.
If I sign the contract now, will i be able to avail the 7500 $ tax credit.
